SIGNATURE NANNIES — CANDIDATE AGREEMENT / APPLICANT TERMS & CONDITIONS

PURPOSE
This Candidate Agreement ("Agreement") is entered into between Signature Nannies ("Agency") and the applicant ("Candidate"). The purpose of this Agreement is to define the terms under which the Agency may assist the Candidate in obtaining employment with families, private households, or affiliated clients seeking childcare or domestic staffing services.
1. TERM
This Agreement begins upon acceptance (electronic or written) and remains in effect unless terminated by either party.
2. AGENCY ROLE
Signature Nannies is a referral and placement agency only. The Agency may:
• review applications
• screen and interview candidates
• verify references
• request background checks
• present candidates to families
• facilitate employment discussions
The Agency is not the employer unless stated in a separate written agreement.
3. NO GUARANTEE OF PLACEMENT
The Agency does not guarantee job placement, interviews, employment duration, number of referrals, or compensation level.
4. CANDIDATE FREEDOM
The Candidate may accept or decline any position offered through the Agency. The Candidate agrees to act professionally and communicate decisions promptly.
5. APPLICANT SERVICE TERMS
There is no upfront cost to apply or be considered by Signature Nannies.
6. CANDIDATE SERVICE FEE (AGENCY COMPENSATION)
The Candidate acknowledges that Signature Nannies provides professional placement services on their behalf.
• Upon confirmed hiring through the Agency,
• The Candidate agrees to pay a one-time service fee equal to one (1) full week of gross compensation.
Payment Timing: This fee is due one (1) week after the Candidate begins employment.
Definition of Weekly Compensation includes: hourly rate × weekly hours, fixed salary, or equivalent weekly value (live-in, overnight, travel roles).
Scope: Applies to employment obtained directly through Agency introductions, indirectly through Agency referrals, or through affiliates or related parties.
Failure to Pay may result in collection action, legal recovery, and additional costs and fees.
7. DUTIES & PROFESSIONAL CONDUCT
The Candidate agrees to provide high-quality childcare or household support, act professionally at all times, follow lawful instructions from employers, maintain reliability and punctuality, and perform only duties they are qualified to perform.
8. CANDIDATE REPRESENTATIONS
The Candidate confirms: all information provided is true and complete; they are at least 18 years old; they are legally authorized to work in the U.S.; they will provide documentation if requested; they consent to screening and verification.
9. INDEPENDENT STATUS
The Candidate is not an employee of the Agency. The Agency is not responsible for wages, benefits, insurance, taxes, or employment conditions. These are solely between Candidate and Employer.
10. CLIENT / FAMILY DISCLAIMER
The Candidate understands the Agency cannot guarantee family behavior; employment decisions are the Candidate's responsibility; the Candidate accepts all risks of employment. The Candidate releases the Agency from liability related to family conduct.
11. NON-CIRCUMVENTION (CRITICAL CLAUSE)
The Candidate agrees that any client introduced by Signature Nannies remains protected. For 2 years, the Candidate may NOT:
• accept employment outside the Agency after introduction
• refer that client to others
• assist in bypassing Agency fees
• help clients hire outside the Agency
Violation results in full placement fee liability and legal enforcement.
12. NON-SOLICITATION
The Candidate agrees not to interfere with Agency clients, recruit Agency candidates, or damage Agency relationships.
13. CONFIDENTIALITY & PRIVACY
The Candidate agrees to keep strictly confidential all information related to families, children, addresses, schedules, personal details, and Agency operations. The Candidate may NOT post on social media, share with third parties, or disclose private information. This obligation lasts 5 years.
14. NON-DISPARAGEMENT
The Candidate agrees not to make false or harmful statements about the Agency, clients, or staff.
15. BACKGROUND CHECK AUTHORIZATION
The Candidate authorizes the Agency to verify references, conduct background checks, and verify identity and employment history. The Candidate consents to sharing this information with potential employers when necessary.
16. IDENTITY VERIFICATION
The Candidate agrees to provide valid identification, including a driver's license or government-issued ID.
17. PROHIBITED CONDUCT
The Candidate agrees not to provide false information, falsify documents, misrepresent experience, breach confidentiality, or misuse client relationships.
18. INDEMNIFICATION
The Candidate agrees to indemnify and hold harmless the Agency from claims, damages, legal costs, and losses arising from breach of this Agreement, misconduct, or false information.
19. NO WARRANTIES
All services are provided "as is." The Agency does not guarantee employment, outcomes, or compatibility.
20. GOVERNING LAW
This Agreement is governed by the laws of Florida. Any disputes shall be resolved through binding arbitration in Florida.
21. ENTIRE AGREEMENT
This Agreement represents the full understanding between the parties and overrides all prior communications.
22. ELECTRONIC SIGNATURE
The Candidate agrees that checking a box, typing their name, or submitting a form constitutes a legally binding signature.
